The course KonaCPR offers for CPR and First Aid training is Emergency First Response.  The Emergency First Response program teaches the same skills as found within the American Heart Associated or American Red Cross First aid and CPR courses.  This course meets requirements for CPR and First Aid in the workplace (OSHA Guideline 29 CFR 1910.151), and incorporates the latest procedures for emergency patient care. Other organizations that recognize EFR as meeting their requirements are United States Coast Guard, The Boy Scouts of America, and the American Council on Exercise (ACE), Hawaii Massage Board, Hawaii DOE and many more.

Along with using the latest methods, manuals and training videos for teaching, we teach classes with low group sizes to manikins, AED trainers and introduce students to oxygen administration.  Manikins used teach and provide real-like stimuli to compression and rescue breaths as manikins require proper head tilt/chin lift techniques to open airways for rescue ventilation, give visible chest rise with breaths, have anatomical landmark points and audible compression clickers when correct depth of compressions are reached.

Information for Businesses:

Is your company compliant with current State and Federal First Aid standards? 

Even if you are complaint, your company could still be open for lawsuit for failing to have adequate emergency procedures in place, why?

 

At present there is no legal obligation that business establishments render aid to patrons.  Past legal precedents, in fact, limited liability of “duty of care” to an establishment being able to call EMS for an injured patron.  Times are changing.

 

In June of 1996 Busch Gardens was found negligent by a Florida court for not properly training employees to render emergency care, and FOR failing to have proper medical equipment on premises.  The plaintiff in this case was awarded $500,000 in damages.

 

Shortly after, a Federal judge found Lufthansa Airlines negligent for failing to provide treatment to an injured passenger.  The plaintiff was awarded $2.7 million in damages.

 

Here in Hawaii, lawsuits have arisen when boat crew failed to respond to the aid of patrons injured after hitting a whale.

 

These are just a few cases.  More arise each day.  Although new case laws and suits are quickly establishing a new standard of care to patrons, current laws do outline specific requirements in emergency response training preparedness for your employees.


OSHA's standard for first aid training in general industry, 29 CFR 1910.151(b):
"In the absence of an infirmary, clinic, or hospital in near proximity to the workplace which is used for the treatment of all injured employees, a person or persons shall be adequately trained to render first aid. Adequate first aid supplies shall be readily available."

What is readily available?
"An employer who contemplates relying on assistance from outside emergency responders as an alternative to providing a first-aid-trained employee must take a number of factors into account. The employer must take appropriate steps prior to any accident (such as making arrangements with the service provider) to ascertain that emergency medical assistance will be promptly available when an injury occurs. While the standards do not prescribe a number of minutes, OSHA has long interpreted the term "near proximity" to mean that emergency care must be available within no more than 3-4 minutes from the workplace, an interpretation that has been upheld by the Occupational Safety and Health Review Commission and by federal courts."


Solution?

"One option these standards provide employers is to ensure that a member of the workforce has been trained in first aid. This option is, for most employers, a feasible and low-cost way to protect employees, as well putting the employer clearly in compliance with the standards." 

 

Although regulations only specify one employee on each shift needs to be trained, remember care must be in “near proximity”.  By training all employees your business is safeguarded that any employee coming upon another employee or a patron in need can instantly offer help.  This help may not only save the persons life, but may stop a lawsuit for failure to aid.
